ORDINANCE NO. 06-104

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HAWK COVE, TEXAS, ESTABLISHING A FEE SCHEDULE FOR THE CITY OF HAWK COVE; ADOPTING THE RATES FOR THE PROVISION OF SEWER USAGE; ADOPTING RATES FOR SERVICE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the City of Hawk Cove, Texas, ("City"), has entered into a loan agreement ("Loan") with the U.S. Department of Agriculture to provide sewer services to its residents; and

WHEREAS, the City has the lawful authority to regulate sewer usage rates for customers of its sewer usage services; and

WHEREAS, the City must establish sufficient customer charges and rates to repay the Loan: and

WHEREAS, the City of Hawk Cove has determined the need to establish sewer rates and service fees to comply with Loan requirements.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HAWK COVE, TEXAS, AS FOLLOWS:

Section 1

The above recitals are hereby found to be true and correct and are incorporated herein for all purposes.

Section 2.

The Sewer Usage Rates is hereby adopted to read as follows:

SEWER USAGE RATES

1) Sewer Service

a. $150.00 customer deposit*

b. $50.00 reconnect fee

c. $50.00 disconnect fee

d. $43.25 flat rate customer connection fee to all accounts

* A customer may build-up the required deposit by paying 1/3 of the deposit for each of the first three months before service commences.

2) Sewer Connection Fees

a. 4 inch tie-in ...$50.00

b. 6 inch tie-in ...$75.00

c. 8 inch tie-in ...$125.00

3) Sewer Taps ...100% of Cost of Installation + Sewer Connection Fee + Monthly Fee

Section 3

It is the intent of the City Council that each paragraph, sentence, subdivision, clause, phrase or section of this Ordinance be deemed severable, and should such paragraph, sentence, subdivision, clause, phrase or section be declared invalid or unconstitutional for any reason, such declaration of invalidity or unconstitutionality shall not be construed to affect the validity of those provisions of this Ordinance left standing, or the validity of any other Ordinances of the City of Hawk Cove.

Section 4

The Sewer Usage Rate Fees established by this Ordinance shall take effect on the date of adoption, and it is accordingly so ordained.

PASSED, APPROVED, AND ADOPTED THIS 29th DAY OF JUNE 2006.

ORDINANCE NO. 06-104 ADDENDUM

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HAWK COVE, TEXAS ESTABLISHING A FEE SCHEDULE FOR THE CITY OF HAWK COVE, ADOPTING THE RATES FOR THE PROVISION OF NEWER USAGE, ADOPTING RATES FOR SERVICE, PROVIDING A SEVERABLILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

SECTION 2. SEWER USAGE RATES

(1) d. $43.25 flat rate customer connection fee to all accounts.

Change to:

(1) d. $53.25 flat rate customer connection fee to all accounts

PASSED, APPROVED, AND ADOPTED THIS 1st DAY OF APRIL 2013.

ORDINANCE NO. 06-104 ADDENDUM

The City Council of Hawk Cove has added an addendum to Ordinance No. 06-104

Add to Section 2.

(4) Sewer late charges (if bill is not paid)

a. After 10th of month - $10.00 will be added to bill

b. After 24th of month - $25.00 will be added to bill

(5) Water and Sewer Disconnected

a. If sewer bill is not paid by the 24th of the month water and sewer will be disconnected until full bill is paid.

b. A fee of $120.00 will be required also for disconnect/reconnect and added to bill in addition to what is already owed to have the water turned back on.
