AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HAWK COVE REGULATING RESIDENTAL SIGNS, PROVIDING AN OFFENSE AND A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DAТЕ. WHEREAS, the City Council of the City of Hawk Cove, Texas has determined the signs on personal property in the City of Hawk Cove are unlimited in scope of duration, and have a negative impact on property cosmetically; and WHEREAS, it is the intention of the City Council of the City of Hawk Cove, Texas to require limits on the number, the kind and the duration of each sign; and WEREAS, the City Council recognizes that the regulation of signs is within the police power of the City of Hawk Cove. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HAWK COVE, TEXAS, THAT: SECTION 1. That all of the above premises are hereby found to be true and correct and are hereby approved and incorporated into the body of this ordinance as if copies in their entirety. SECTION 2. The City Council for the City of Hawk Cove hereby adopts the following ordinance which shall read as follows: A. All signs on personal property shall be professionally done if intended to be of a permanent nature or for a duration of more than one (1) week, and shall not consist of more than one (1) sign per property. B. All signs require a permit from the City for a fee of $35.00, to be approved by the City, and are required to be renewed each year in the month of January, if permanent. C. All signs shall be maintained in a state of good repair, and neat appearance at all times. Signs may not be illuminated. D. All signs in the front or side yard, if the house is on a corner, shall be of an appropriate size, not to exceed 32 square feet. E. The code enforcement officer may order the removal of any sign that is not approved or, is not in compliance with city ordinance. F. A person commits an offense if the person fails to comply with a provision of this ordinance. An offense under this section in a misdemeanor punishable by a fine not to exceed $200.00, and each and every day this ordinance is violated shall constitute a separate offense. SECTION 3. If any section, article, paragraph, sentence, clause, phrase, or word in this ordinance or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holdings shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Hawk Cove, Texas, hereby declares it would have enacted such remaining portions, despite such invalidity. SECTION 4. This ordinance shall be in full force and effect immediately upon its passage, approval and adoption. PASSED, APPROVED, AND ADOPTED THIS 1st DAY OF OCTOBER 2013.
