'''AN ORDINANCE OF THE CITY OF HAWK COVE ESTABLISHING ALTERNATING TWO YEAR TERMS FOR THE OFFICE OF MAYOR AND ALDERMEN; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE.'''

'''WHEREAS,''' by an election dated January 16, 1999, the City of Hawk Cove incorporated as a Type B-General Law municipality; and

'''WHEREAS,''' the governing body of the City of Hawk Cove consists of a mayor and five aldermen, who were initially elected May 1, 1999; and

'''WHEREAS,''' the City of Hawk Cove, as a Type B-General Law Municipality, pursuant to Section 23.026 of the Texas Local Government Code, may adopt an ordinance providing for two-year staggered terms for the offices of the Mayor and the Aldermen.

'''NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HAWK COVE, TEXAS:'''

==SECTION 1==
Incorporation of Recitals.

The above recitals are hereby found to be true and correct and incorporated herein for all purposes.

==SECTION 2==
Establishment of Two-Year Staggered Terms of Office.

In lieu of the one-year terms of office, the mayor and aldermen of the City of Hawk Cove shall be elected for two-year staggered terms. The Mayor and Aldermen for Place 4 and 5 shall serve for a two-year term. All subsequent elections for Mayor, Alderman, Place 4 and Alderman, Place 5 shall be for two-year terms and shall occur in odd numbered years. Alderman, Place 1, Alderman, Place 2, and Alderman, Place 3, shall be elected for two-year terms in even numbered years.

==SECTION 3==
Severability.

If any provision or portion of this ordinance or its application to any person or circumstance is held to be invalid or unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portion of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this ordinance despite such invalidity and the remaining portions shall remain in full force and effect.

==SECTION 4==

Effective Date. This ordinance shall become effective upon passage and publication in accordance with law.

PASSED, APPROVED AND ADOPTED THIS 10th DAY OF JUNE, 1999.
