'''WHEREAS,''' the City of Hawk Cove, Texas, ("City"), has entered into a loan agreement ("Loan") with the U.S. Department of Agriculture to provide sewer services to its residents; and

'''WHEREAS,''' the City has the lawful authority to regulate sewer usage rates for customers of its sewer usage services; and

'''WHEREAS,''' the City must establish sufficient customer charges and rates to repay the Loan: and

'''WHEREAS,''' the City of Hawk Cove has determined the need to establish sewer rates and service fees to comply with Loan requirements.

The above recitals are hereby found to be true and correct and are incorporated herein for all purposes.

==Section 2.==
The Sewer Usage Rates is hereby adopted to read as follows:

:: a. $150.00 customer deposit*
:: b. $50.00 reconnect fee
:: c. $50.00 disconnect fee
:: d. $43.25 flat rate customer connection fee to all accounts

: 2) Sewer Connection Fees

==Section 3==
It is the intent of the City Council that each paragraph, sentence, subdivision, clause, phrase or section of this Ordinance be deemed severable, and should such paragraph, sentence, subdivision, clause, phrase or section be declared invalid or unconstitutional for any reason, such declaration of invalidity or unconstitutionality shall not be construed to affect the validity of those provisions of this Ordinance left standing, or the validity of any other Ordinances of the City of Hawk Cove.

The Sewer Usage Rate Fees established by this Ordinance shall take effect on the date of adoption, and it is accordingly so ordained.

The City Council of Hawk Cove has added an addendum to Ordinance No. 06-104

Add to Section 2.
: (4) Sewer late charges (if bill is not paid)
:: a. After 10th of month - $10.00 will be added to bill
:: b. After 24th of month - $25.00 will be added to bill
: (5) Water and Sewer Disconnected
:: a. If sewer bill is not paid by the 24th of the month water and sewer will be disconnected until full bill is paid.
:: b. A fee of $120.00 will be required also for disconnect/reconnect and added to bill in addition to what is already owed to have the water turned back on.
